On Friday, the US Supreme Court declined an immediate consideration of a plea from special counsel Jack Smith to determine whether ex-President Donald Trump could face prosecution for his efforts to overturn the 2020 election results.

The justices, rejecting an unusual plea by special counsel Jack Smith, chose not to skip a lower appeals court to hasten a final decision on Trump’s immunity claims before his trial, scheduled for March.

In a concise one-page order without additional details, the court made its decision, with no justice expressing dissent. The matter will now be resolved by the US Court of Appeals for the District of Columbia Circuit, which has indicated a prompt resolution of the case.

Trump’s Celebration

This decision stands as a win for Trump and his legal team, actively seeking to postpone a criminal case against him as he pursues a return to the White House in 2024.

It prevents a quick ruling from the nation’s highest court, which could have definitively rejected his immunity claims and raises questions about the landmark trial proceeding on March 4.

In a message to his supporters, Trump hailed the Supreme Court decision as a triumph but acknowledged, “I will still have to fight for my rights in the Appeals Court.”

Charges Against Trump

Prosecutors allege that Trump, the leading contender for the 2024 Republican presidential nomination, tried to obstruct Congress and deceive the US government in a bid to overturn the 2020 election results.

Trump contends the case should be dismissed, arguing that former presidents cannot face criminal charges for actions tied to their official duties.

On December 1, US District Judge Tanya Chutkan dismissed this argument, prompting Trump to appeal to the US Court of Appeals for the District of Columbia Circuit. Trump’s appeal has temporarily halted his trial, initially slated for March.

To prevent delaying the trial further, on December 11, Smith urged the Supreme Court to expedite a decision.
